Colombia is a Social State of Law, which has as one of its main obligations the protection of fundamental rights, guided by constitutional principles such as equality and human dignity, enshrined in the Political Constitution of 1991, seeking the protection of minimum guarantees to which all sectors of society, without any distinction or discrimination, must have access. The Constitution, jurisprudence and the law have confirmed international treaties on labor matters, which broadly express the labor rights of all persons and the prohibition of situations of labor exclusion, seeking for the protection of the right to work of those minorities such as the LGTBIQ+ population. Despite the above, in Colombia the recognition of labor guarantees for LGTBIQ+ persons are still under debate, so it is not known what their current situation is in the country. This research aims to analyze this situation, resorting to the review of bibliographic data, case studies and statistical data conducted by consulting centers in the country and departments trained for this purpose, which yielded the conclusions and recommendations detailed at the end of this research work.
