The institution of the benefits for effective collaboration with the justice, is determined by the need to fight the reigning impunity in most of the processes in which it was not possible to have identified the authors or participants, to break the silence that reigns in the organized delinquency and to serve as instrument of prevention of the commission of crimes of big social dañosidad. These benefits, given its transactional character, demand of the beneficiary the supply of an information, test, effective denunciation, etc., in exchange for a reduction of sorrow, granting of the conditional release, home detention or replaced penalty. In the plane of the constitutional law, the designs of negotiated penal justice have had to spend for real acid tests, topcoat in those countries where the budgets produce traditionally of the procedural law subjec t to the irrestricta evaluation of the beginning of legality. Nevertheless, it is not necessary to forget that in the last three decades, the developments of the public law have showed an evolution where the postulates of prompt and complete justice materi alize necessary in the formula of the right to a process without undue delays, as have exhibited it between others, the Spanish and Colombian constitutions making the interpretation more flexible. To it it is necessary to add that the constitutional reinte rpretation of the right of defense

The coexistence of a man and a woman is a need for natural and biological order, and it can go over to this union by means of rites, ceremony, civil or religious acts, or for the simple fact of the union without fulfilling any formality. This informal union called of diverse nature in the course of the juridical history of the world, is what before the law 54 of 1990, was named a Concubinage in our legislation This denomination, of for itself shameful, was adding in the long run list of denigrating names that was granted to this type of unions and that in its historical moment were concubinages, cohabitations, barraganias, etc., 54 of 1.990 was changed into the marital union really established and recognized by the law The legislative footpath that the informal unions have had to face to obtain its legal recognition, has been rough and desert. But, with the expedition of the law earlier written down and the promulgation of the political constitution of 1.991, a legal frame has been obtained so that it is possible to do justice opposite to a fact of undeniable hereditary and social consequences.

El Acto Legislativo 03 de 2002 reformó la Constitución con la aplicación del Principio de Oportunidad, proceso mediante el cual la Fiscalía podrá interrumpir, suspender y/o renunciar a la persecución penal de los individuos que hayan cometidos alguna conducta punible. El objetivo de esta investigación fue el de determinar la procedencia del principio de oportunidad de los desmovilizados de las AUC por delitos cometidos antes de la vigencia de la 906 de 2004. Se utilizó para esta investigación la metodología utilizada fue el método deductivo, el cual parte de una realidad general a una particular, como es la procedencia del principio de oportunidad. En conclusión se puede decir que por razones del tiempo en que se realizaron muchas de las conductas de estos desmovilizados, se deberían trasgredir bajo el influjo de la normatividad de la ley 600 y por la carencia de identidad procesal entre el principio de oportunidad con la mencionada norma, no es posible argumentar dicha aplicación. Por el contrario esta actividad se debe enmarcar bajo la óptica acusatoria, que desarrollaría su aplicación y argumentación jurídica.
