AbstractThe present investigation is entitled Adoption of children by same-sex couples, in which the LGBTI community seeks to have their rights guaranteed in order to build a family. The objective pursued is the best interest of the child before equal marriage and the right to have a home, protection, care and stability of parents or mothers; for this, since the constitution of 1991, it has been working for equality of conditions and gender that society rejected or rejected. Another body in charge is the Constitutional Court has regulated rights so that people of the same gender that in the light of the 1886 constitution were simply prohibited, today these prohibitions have been protected whose purpose is for the legislator to analyze the rules that international treaties provide as guarantee mechanisms so that the norm in Colombia is adapted and interpreted favorably, through jurisprudence this kind of rights are taken into account beginning with the change of name with the sentence T-594/93, recognizing the State that each person chooses who wants to be without impediment to others according to the principle of the free development of personality, with the sentence T-290/95, is to protect a child in a state of helplessness through adoption but ultimately the ruling was denied . On the other hand to accept the equal marriage passed years after years and finally in our country was ruled in favor of homosexuals, then the adoption was demanded and only until 2015 with the sentence C-683/2015 the legislator said that The adoption of children by same-sex couples would be enabled by virtue of the best interests of the child. People who do not agree with the ruling comment that children adopted by homosexuals will suffer psychological, moral and that could be the same as their adoptive parents, that is why the State should implement programs, give talks, conferences so that people are aware that it is not a harm to society, but a protection to a minor and to break down imposed barriers guaranteeing the child the right to have a family that protects it against society.
