El reconocimiento de derechos a la comunidad LGBTI

La sociedad actual presenta nuevos lineamientos de debate en el área social y jurídica, respecto al reconocimiento de derechos a las personas no heterosexuales. Los Derechos Humanos (Alexy (1995) y los principios constitucionales promulgados en la Carta Magna, establecen literalmente la dignidad humana como principio y fundamento de los derechos, entendiendo al ser humano como elemento de absoluta protección. Es indispensable considerar el contexto social de las minorías sexuales para fundamentar la necesidad imperiosa de normar en materia de igualdad jurídica y libre orientación sexual, teniendo en cuenta el Derecho Internacional de Derechos Humanos, el principio de igualdad y no discriminación y los contenidos desarrollados por la Corte Constitucional de Colombia Contemporary society presents new guidelines in social and legal debate concerning the acknowledgement of rights of non-heterosexual people. Human Rights (Alexy, 1995) and Constitutional principles promulgated in the Magna Carta literally establish human dignity as principle and foundation of rights, understanding the human being as an entity liable for absolute protection. It is essential to consider the social context of these sexual minorities to support the imperative need to establish norms for legal equality and free sexual orientation, having into account International human rights law, equality and non-discriminationprinciple, and the contents developed by the Constitutional Court of Colombia
