En el presente artículo se plantea la protección especial de los derechos del administrado frente al abuso del derecho, en el caso puntual del cobro coactivo injustificado. Para estudiar tal problemática se indagan los supuestos fácticos que originan tal estado de cosas, respecto al derecho administrativo, en el cual la administración como organismo facultado para accionar al administrado, tiene la obligación legal y el deber constitucional de operar su actuación, teniendo en cuenta los presupuestos normativos. Se dará respuesta al problema planteado, en los siguientes términos: ¿Constituye un abuso del derecho el cobro coactivo injustificado por parte de la administración?, ¿representa un menoscabo de los derechos fundamentales del administrado? Se contrasta el fenómeno jurídico del abuso del derecho, en sus rasgos generales, pero en la determinación del resultado para presentar soluciones concretas a la problemática se aplicará concretamente al cobro coactivo injustificado, como una práctica que origina un abuso del derecho, y una vulneración de los derechos constitucionales fundamentales del administrado.
 
This paper sets forth the concept of special protection for the rights of a person adversely affected or aggrieved by an unreasonable exercise of rights, particularly, the case of undue enforcement of coercive collect jurisdiction. To study such predicament, factual assumptions originating the given situation are investigated according to administrative law, in which the Directorate of Coercive Jurisdiction, as the body in faculty to conduct the executive process, has the legal obligation and constitutional duty to conduct the executive process having into account the regulatory premises. The solution to this situation will be provided in the following terms: Is the undue enforcement of coercive collect jurisdiction an abuse of rights? Does it represent a derogation of the fundamental rights of the aggrieved person? The legal phenomenon of abuse of rights is contrasted considering its general characteristics, but for determining the results to provide concrete solutions to this issue, the coercive collect jurisdiction will be regarded as a practice that generates abuse of rights and an infringement of the aggrieved person’s fundamental rights.

    When environmental rights are promulgated in the third generation of human rights, the signatory states must carry out public policies aimed at guaranteeing said recognized rights, so it is not alien to the Colombian legal system to propose environmental public policies in accordance with those required by international law , for which such existing public policies either by the implementation of international treaties or by recognitions of the constitution, the law and in special cases by the jurisprudence of the high courts, which is eloquent in the face of the expectations of the international under the protection of rights in general. This is why the commitment to environmental rights is international in nature, so it is important to investigate and learn about the environmental public policies promoted in the government of Iván Duque Márquez in his first two years of government, so that the sanctioned laws will be observed. and the administrative management of the government regarding environmental and ecosystem issues, since it is an international obligation to protect this environment to guarantee current and future generations a healthy, dignified and sustainable environment for their existence. The paradigm is to know the equity of environmental law, economic rights, private property and sustainable development, this if they can go hand in hand and if the management of environmental public policies are on the way to the general protection of the environment by the government through implementation of sustainable environmental policies, mitigation against climate change and technical scientific assessment of resources and if they respond to these needs in an efficient, effective and effective way in the face of polluting phenomena and disproportionate economic activities that systematically affect the environment environment and causing systematic and irreparable damage. Once environmental management is known in its first two years, it will be possible to identify the concordance with the third generation of human rights against environmental law and the principle of solidarity since it is not only management of the national government but of each of the entities of control, government entities and the people of the communities in general. In terms of environmental rights, it is a very broad branch and more so in a country like Colombia due to its mega diverse geographical characteristics, as well as the importance of knowing current environmental risks and the way in which they are managed is a tool for the implementation of adequate policies and environmental intervention in an efficient way, where the community in general, the control entities, the municipal and departmental administrations together with the national government and the indigenous and special territories, can work on mega diverse environmental policies aimed at a real sustainable development and where true strategies are proposed for current and future situations with the incorporation of scientific, technical and technological and legal legal tools that contribute to the exercise of protection and adequate environmental administration, as this is a social and human duty, since the commitment is to preserve this environment and guarantee a vine shape To dignify future generations this is the basis of all international treaties by which they seek through the principle of solidarity to generate awareness and commitment to the environment. The most important thing in this current situation is to consider whether it is acting in accordance with international human rights principles or simply the governments and especially the management of the current president Ivan Duque Marquez and the control entities are navigating a sea. of dead words that do not guarantee the preservation of any specific right, even more environmental rights considering that there is no efficient guarantee that prevents in advance any phenomenon or fact that threatens the environment.

    Surrogacy is a practice by means of which a woman carries a baby for another person or partner so that the latter can be a mother and/or biological father. Surrogacy is an increasingly common practice in Colombia. Therefore, the main objective of this research is to analyze this practice in the Colombian State. In the present work, the socio-legal paradigm, the hermeneutical method, and a section of analytical research were used. From the analysis it is verified, firstly, that in Colombia three bills have been promulgated to regulate the practice of surrogacy, but none had the necessary support; secondly, that there is a landmark judgment of the Constitutional Court on the practice of surrogacy, establishing the requirements in which such practice could occur; thirdly, that according to the Political Constitution of Colombia, surrogacy implies the violation of certain fundamental rights and that, according to civil law, it does not comply with what is stipulated in relation to contracts; fourthly, that surrogacy implies the violation of human rights. It is concluded that the State of Colombia should prohibit the practice of surrogacy since it involves the violation of fundamental and human rights enshrined in international conventions, as well as established in the Constitution.
