El Sistema De Riesgos Laborales En Colombia

Abstract

Este artículo de revisión tiene dos fines específicos, realizar un análisis de los antecedentes del Sistema General de Riesgos Laborales en Colombia y la determinación de los cambios introducidos por la Ley 1562 de 2012; a fi n de establecer si estos son coherentes con los objetivos del sistema, el cual pretende una protección integral del trabajador preventiva y/o contingente a través de las entidades públicas y privadas destinadas a atender a los trabajadores en todas aquellas vicisitudes que en materia de salud y riesgos laborales puedan presentarse, producto de su actividad laboral. Para ello se empleó un estudio jurídico descriptivo con aplicación de los métodos analítico e inductivo, permitiéndonos obtener la identificación de las motivaciones e inquietudes en cuanto si el cambio normativo generó un simple cambio en la terminología, o si realmente se amplió la cobertura estableciendo mecanismos que permitan la inclusión al sistema de trabajadores independientes e informales

This review article has two specific purposes, an analysis of the background of the General System of Occupational Risks in Colombia and the determination of the changes introduced by Law 1562 of 2012, in order to establish whether these are consistent with the objectives of system, which seeks comprehensive protection preventive worker and/or contingent through public and private partnerships to assist workers in all the vicissitudes of health and occupational hazards can submit product of their work. For this study we used a descriptive legal application of analytic and inductive methods, allowing us to obtain the identification of the motivations and concerns about regulatory change gender itself a simple change in terminology, or if coverage was extended really establishing mechanisms allow the system to include employed and informal workers.
