Importancia de los informes psicológicos forenses en las decisiones judiciales de primera instancia en delitos sexuales en la ciudad de Barranquilla

Abstract

Los delitos sexuales son aquellas acciones que vulneran los Derechos a la Libertad e Integridad Sexual, afectando a personas de cualquier edad y sexo; representando una conducta punible, antijurídica y típica. La presente investigación analiza la importancia de los informes psicológicos forenses en las decisiones judiciales de primera instancia en delitos sexuales en la ciudad de Barranquilla, Colombia, esto mediante un enfoque cuantitativo de alcance descriptivo. Por tal motivo se analizaron diversas variables con el propósito de categorizar si en las sentencias tomadas como muestra se hace mención pericial del peritaje psicológico por parte del Juez al momento de dictar sentencia, y cuál es el valor diferencial de los informes psicológicos forenses; es decir que técnicas o baterías de pruebas fueron utilizadas en el peritaje; también se revisó la concordancia entre la decisión final del Juez y los resultados plasmados en el informe psicológico forense. Como resultados significativos se obtuvo que en el 80.0% de las sentencias se realizó mención pericial por parte del Juez al fundamentar las razones en virtud por las cuales tomó su decisión final, asimismo en un 80.0% el Juez tomó la decisión final del sentido del fallo de una manera concordante con los resultados del informe psicológico forense. Como conclusión, se plantea que para la administración de justicia se requiere y hace imperioso el apoyo de personal auxiliar especializado y que el psicólogo jurídico en función forense funge como fuente directa de conocimiento, cuyo aporte se constituye como un medio de convicción apreciable.

Sex crimes are actions that violate the Rights of Freedom and Sexual Integrity, affecting people of all ages and sex; representing an unlawful behavior that can be punish by the law. This research analyzes the importance of forensic psychological reports on judicial decisions by first instance courts in sex crimes in the city of Barranquilla, Colombia, this by using a quantitative descriptive methodology. Therefore different variables were analyzed in order to know the mention of the forensic psychological evaluation by the judge when sentencing, and what is the differential value of the forensic psychological reports; ie which techniques or tests were used in the evaluation; as well it was reviewed the correlation between the final decision of the judge and the results reflected in the forensic psychological report. As significant results were identified that in 80.0% the judge mentioned the psychological evaluation to substantiate the reasons of the sentence, also in 80.0% the judge made the sentence in a consistent manner with the results of the report. In conclusion, we propose that for justice administration it is imperative the support of specialized auxiliary personnel and that legal psychologist serves as a direct source of knowledge, whose contribution is established as a significant means of conviction.
