Análisis de la ley de justicia y paz como justicia transicional

La justicia y la Paz, como elemento de transición, son elementos indispensables para el Desarrollo Humano Sustentable y en sí mismos son valores que se informan mutuamente, se condicionan y se retroalimentan. Sin embargo, la búsqueda de la paz puede implicar, en casos de conflicto como el que vive Colombia con los grupos organizados al margen de la ley, el sacrificio de una Parte de la justicia así como algunas restricciones a otros derechos humanos. El presente estudio versa principalmente sobre la ley de Justicia y Paz (ley 975 de 2005) como una ley de transición, Para lo cual empieza por analizar su validez constitucional y la forma en que fue reglamentada, luego de ello entramos a revisar hasta qué punto la restricción de los derechos particulares relacionados con la justicia se legitima con la búsqueda de una paz sustentable y en especial, cuál es el límite de la Jurisdicción Internacional en la materia, a fin de determinar si el proceso de Justicia transicional que se desarrolla en Colombia es compatible con el Desarrollo Humano Sustentable y si, sus consecuencias se justifican frente a Dicho objetivos Justice and Peace, as a transition, are essential for sustainable human development and as such are values that inform each other, condition and feed. However, the search for peace may involve, in cases of conflict such as in Colombia with organized groups outside the law, the sacrifice of a part of justice and some other restrictions on human rights. This study focuses mainly on the Justice and Peace (Act 975 of 2005) as a transitional law, which begins to analyze the constitutional validity and the way it was regulated, after that we went to check to what extent the restriction of individual rights related to justice are legitimate to the search for sustainable peace and in particular what is the limit of the International Court in the matter, to determine if the transitional justice process that takes place in Colombia is compatible with sustainable human development and whether its consequences are justified against said objectives.
