In surgical obligation, medical responsibility only appears in the head of the surgeon as head of the ward; that is why, the importance of evaluating the responsibility of all the participants of the surgical act, establishing who is responsible and who should compensate the damage. It is evident that in the presence of a surgical oblite there is a person in charge who has the obligation to repair the damage caused, also that the instrumenter's own function consists mainly of supervising the surgical medical equipment and materials that enter the surgery room. ; This being true, the assessment of responsibility should not only be directed towards the surgeon, but also towards the instrumenter and the surgical team. In this work the surgical oblite will be analyzed as an involuntary error in the exercise of surgical instrumentation and the factors that increase the risk of forgetting foreign bodies in the body of patients during a surgical intervention will be identified. This research will be of a socio-legal nature and will be carried out under the aspect of a documentary and hermeneutical study. It is concluded that the proper function of the instrumenter consists mainly in supervising the surgical medical equipment and materials that enter the operating room; This being true, the assessment of responsibility should not only be directed towards the surgeon, but also towards the surgical instrumenter and the surgical team. En oblito quirúrgico, la responsabilidad medica solo figura en cabeza del médico cirujano como jefe de la sala; es por ello, la importancia de evaluar la responsabilidad de todos los participantes del acto quirúrgico, establecer quien es el responsable y quien debe indemnizar el perjuicio. Es evidente, que ante la presencia de un oblito quirúrgico existe un responsable que tiene la obligación de reparar el daño causado, también que, la función propia del instrumentador consiste principalmente en supervisar el equipo y los materiales médicos quirúrgicos que ingresan a la sala de cirugía; siendo esto cierto, la evaluación de la responsabilidad no solo debe ir dirigida hacia el cirujano, sino hacia el instrumentador y el equipo quirúrgico. En este trabajo se analizará el oblito quirúrgico como error involuntario en el ejercicio de la instrumentación quirúrgica y se identificarán los factores que aumentan el riesgo de olvidar cuerpos extraños en el cuerpo de los pacientes durante una intervención quirúrgica. Esta investigación será de carácter socio- jurídico y se efectuará bajo el aspecto de un estudio documental y hermenéutico. Se concluye, que la función propia del instrumentador consiste principalmente en supervisar el equipo y los materiales médicos quirúrgicos que ingresan a la sala de cirugía; siendo esto cierto, la evaluación de la responsabilidad no solo debe ir dirigida hacia el cirujano, sino hacia el instrumentador quirúrgico y al equipo quirúrgico. Deben existir métodos que obliguen al instrumentador a seguir un protocolo estricto para evitar estos eventos y garantizar la seguridad del paciente.
